These Terms of Service ("Terms") govern your access to and use of MedChannel ("Service"), operated by MedChannel ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
MedChannel is a cloud-based platform for medical clinics that turns TVs and browsers into branded waiting-room displays. It provides AI-generated patient-education slide decks and printable handouts, review cards, health tips, live weather and news, an AI social content generator, and an admin dashboard that syncs content to paired screens in real time. The Service is intended for use by clinics and their staff.
2. Account Registration
You must create an account to access the Service. You agree to:
- Provide accurate and complete registration information.
- Keep your login credentials secure and not share them with unauthorised parties.
- Notify us immediately at hello@medchannel.net if you suspect unauthorised access to your account.
- Be responsible for all activity that occurs under your account.
You must be at least 18 years old and have the authority to bind your clinic or organisation to these Terms.
3. Free Trial
New accounts receive a 30-day free trial with access to all features — pairing screens, running the waiting-room channel, and generating AI content. During the trial, AI generation is limited to 3 slide-deck generations and 3 handout generations; paid plans have no such cap.
No credit card is required to start a trial. At the end of the trial period, your account will be restricted unless you subscribe to a paid plan. Trial benefits are available once per clinic and are not transferable.
4. Subscriptions and Billing
Paid subscriptions are billed monthly in advance. By providing payment information, you authorise us to charge your payment method on a recurring basis. All fees are stated in USD and are exclusive of applicable taxes.
- Per Display Plan — $24.99/screen/month, with every feature included. Each screen is billed individually.
- Enterprise Plan — $225/month flat rate. Includes up to 15 screens, team accounts, and priority support.
You may cancel at any time. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide refunds for partial months or unused subscription periods.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Enter individually identifiable patient information (names, dates of birth, MRNs, or other PHI) into any AI feature or display content.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use the Service to generate content that is misleading, defamatory, or harmful.
- Resell, sublicense, or provide the Service to third parties without our written consent.
- Use automated tools to scrape, crawl, or abuse the Service or its APIs.
- Circumvent or attempt to bypass any usage limits or security measures.
6. AI Features and Content Disclaimer
The Service uses AI to generate patient-education slide decks, printable handouts, promotional content, and social media copy based on the topics and branding you provide. This content is intended for general patient education and clinic marketing.
AI-generated content is educational and promotional in nature — it is not medical advice, diagnosis, or treatment. We do not guarantee the accuracy, completeness, or suitability of generated content. You are solely responsible for reviewing everything before it is displayed to patients, printed, or published on your behalf, and for ensuring it complies with the laws and professional standards that apply to your clinic.
7. Intellectual Property
The MedChannel platform, including its software, design, and visual elements, is owned by us and protected by copyright and other intellectual property laws.
You retain ownership of the content you create using the Service (slide decks, handouts, branding configurations, etc.). By using the Service, you grant us a limited licence to host and display your content solely to provide the Service to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
To the fullest extent permitted by law, MedChannel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or damages arising from your use of the Service or reliance on AI-generated content.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the three months immediately preceding the claim.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or fail to pay amounts owed. You may delete your account at any time from the account settings. Upon termination, your right to use the Service ceases immediately.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or prominent notice in the dashboard at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
